The blog fiskarettes is an area dedicated to Internet users interested in arts and crafts, whether they are Fiskars products users or not, dealing in particular with the topics covered on the fiskarettes blog. This Blog can also eventually become a store window and enable Fiskars to promote its brand products.
Fiskars undertakes to respect the privacy of its Blog users, notably their personal data and rights of intellectual property. As such, it has agreed with Vanksen to create the conditions of use and a charter for the respect of privacy, specified hereafter, that they undertake to comply with.
Any user of the Blog is deemed to have read understood and agreed with the Conditions of Use and undertakes to respect them while surfing on the Blog.
1. Conditions of use of the Blog.
The Blog is accessible to any user that has internet access, without any other condition.
Any user can add content to the Blog by posting articles and/or comments, depending on the user’s blog membership status, within the frame of the conditions specified hereafter.
Thus, it is possible:
- For the user of the blog to post his comments about the articles on the Blog,
- For the member to post an article about the topics of the Blog, and notably arts and crafts. A member of the Blog can add pictures with his/her article to illustrate his/her creation, and also post comments on other articles.
Any user wishing to become a member must fulfill the following conditions:
- Reside in the European Union,
- Provide the information asked for on the relevant form (full name, username, post and e-mail addresses, and a password)
- Confirm his/her registration after having received a confirmation e-mail to activate the account.
It is specified that as a member of the Fiskarettes community, a user of the Blog can be contacted directly by Fiskars concerning the activity and the products that it proposes, even if he/she didn’t subscribe to the newsletter.
The participation in the Blog must be in compliance with the following procedure:
- Any user wishing to post a comment must fill-in the relevant form including the text to be published, and his/her full name, username, and mail address. The user can also provide the URL of his/her own website if he/she so wishes.
- Any member wishing to post a comment or an article must log in and provide the text and a picture attached to it, and then validate the relevant form.
All articles and comments are subject to an “a priori†moderation, so they can be read before being published and the Publication Manager reserves the right not to publish articles and comments that are notably:
1 – in conflict with morality, public order, laws and regulations, rights of others.
2 –defamatory, violent or that incite violence, abusive, obscene, offensive, discriminatory, racist, xenophobic, homophobic, pornographic, paedophilic, revisionist or that deny the Holocaust
3 –referring to illegal activities in all their forms, including reproduction, representation or distribution, of unauthorized software, trademarks, photographs, pictures, texts, songs.
4 –not related to arts and crafts or the other topics on the blog.
5– providing directly or indirectly an address or other details of a natural person, therefore making known his or her location.
Moderation conducted by the Publication Manager is done within the limit of his/her means. As such, the Publication Manager may at any time remove any article or comment which does not meet the above criteria from the Fiskarettes blog, especially after receiving requests from third parties in this regard.
It is specified that any comments or articles published on the Fiskarettes blog remains the sole responsibility of its author, or legal representative. Any user must ensure compliance with the above criteria, the rights of others, and the accuracy of its contents before asking for the publication of his/her article or comment. The post will be withdrawn from the blog on demand in writing from the user.
2. Intellectual property
a. Fiskarettes Blog
Any content and notably, but not exhaustively, any logo, mark, video and picture present on the blog are protected under intellectual property law, or any other relevant legal disposition. Fiskars owns all the rights pertaining to the Blog’s content, excluding the ones expressly attributed to third parties.
Any reproduction, dissemination, adaptation of logos, trademarks and other content on this blog, whose ownership is attributed to Fiskars, is prohibited without permission of the latter, both for commercial and non-commercial purposes.
Users and members are in this context only allowed to reproduce the contents of the blog solely for informational purposes and within a strictly private frame.
Fiskars is respectful of the intellectual property rights of third parties, and any legal provision in force for protecting the interests of third parties. Fiskars shall take all measures at its disposal to ensure that the Blog does not violate protected rights.
However, if you believe that the blog is likely to prejudice any of your rights, Fiskars will proceed with the deletion of the content after receiving written notification of the copyright holder, duly justified, to the publication manager at the address mentioned above.
b. Contributors copyrights
The fiskarettes blog offers the possibility to members to publish pictures of their own creations, in accordance with intellectual property law.
Any user wishing to publish a picture on the fiskarettes blog must first fill in the relevant form with all the compulsory elements, specified hereafter:
- Authorisation from the member to the publication manager for the publication and circulation of his/her article, picture and/or article on the fiskars blog without the possibility of retribution.
- Engagement of the member to be the only owner of the intellectual property rights on the posted creation, article and/or comment or at least to have received the authorisation of the rightful author to publish it with a mention of the name of the author.
Every user or member asking for the publication of an article undertakes to respect the intellectual property rights of any third person pertaining to any content (article, image, picture, etc.) notably by the insertion of a mention specifying the sources and/or author when relevant within the article.
Any content published on the Blog will be associated with the member by specifying his/her username, or with the user by specifying its name.
The publication manager is not able to seek the existence of intellectual property rights on every picture, therefore the user is deemed to be the owner of those rights until presentation of the proof of the contrary.
In this context, the company Fiskars invites every third person to notify any harm to their rights by sending a request in writing to withdraw the article by electronic or post mail mentioned here above.
Without prejudice to the legal provisions, Fiskars declines any liability in the event of infringement of intellectual property rights of third parties.
3. Privacy policy
The purpose of this charter is to inform you about the information that can be collected and the way it can be used. It also informs you of your rights to your personal data.
The privacy policy includes respect of the confidentiality of personal data collected by all modules requiring the entry of personal information.
Nature of the collected data
The disclosure of personal data is not a condition of access to the blog or any of its parts. Moreover, no personal information is collected without your knowledge, especially during your navigation on the blog.
The information that we collect is voluntarily disclosed by the user in order to participate in the fiskarettes blog and/or become a member, both of which require filling out a registration form. It is clear that the data disclosed in the latter will not be processed without your consent, given during the validation of each form.
Each form mentions the mandatory fields to fill in, as stated above, or recalled below.
What do we do with this data?
The personal data that may have been gathered on the forms are used by the above mentioned companies for purely technical purposes to ensure a good management of the blog.
The modules available on the blog and calling for the voluntary seizure of personal data are:

- fiskarettes newsletter registration form
Any non-member user is informed that his data will be used only for purely technical purposes to ensure the proper management of the Fiskarettes blog, particularly concerning the moderation of comments and request replies.
It is also clarified that the newsletter aims to inform users about the news on Fiskars and the fiskarettes blog.
Data disclosed by non member users in the frame of these forms will only be used for external communication, and as such will be transmitted to Fiskars, the publication manager and Vanksen within the limit of their function mentioned above, excluding any other person.
Fiskars undertakes in this respect that these data will not in any case be kept and used by it, the publication manager or Vanksen for purposes other than those described above.
All information transmitted by the Member through the forms will be retained by Fiskars, and processed by Fiskars, the publication manager and Vanksen, the latter in their responsibility as the blog moderator and technical manager.
By registering as a Member, the user accepts that his/her data can be stored and used by Fiskars to contact him/her as a customer or potential customer of Fiskars products. As such, the Member may receive by e-mail or post mail, in addition to the aforementioned newsletter when appropriate, any information from Fiskars.
In compliance with the legislation in force, including the amended UK Law Data Protection Act of 1998, anyone providing information via one of the modules mentioned above benefits from:
1. the right of access—you can obtain disclosure of information about you and check the accuracy of such information;
2. the right to rectify—if the information is not accurate, you are allowed to ask for a correction or completion
3. the right of radiation—you can demand the deletion of said information;

Fiskars shall take all necessary measures to protect the personal data of participants from being stolen or any unauthorized access and undertakes to not communicate, disclose or transmit this data to third parties without prior user or member authorisation.
The data disclosed will not in any case be transmitted outside of the European Union.
Privacy of information provided by under age children
Fiskars naturally cares about the security of the information provided by minors. In our modules, minor visitors can voluntarily register for free online modules on the blog. Note that it is not our intention to send e-mails to minor children who did not ask for an intervention from us.
As it is not possible to check the age of every Blog user, the company Fiskars invites any legal representative of an underage child to contact the publication manager in order to withdraw the data disclosed by the child from our database.
4. Links to other websites
The Fiskarettes blog contains links to the official website of the company Fiskars and provides access to the e-card service. The act of clicking on one of these links automatically leads the blog user to these sites, subject to their own conditions for use, not the current terms of use.

It is therefore up to you to take note of the terms of use made by each blog/web site that you visit. In particular, we do not control third party sites in terms of the collection and treatment of personal data or their privacy commitment, even though these sites have a link with the fiskarettes blog. It is therefore up to you to take note of the Fiskars privacy commitments, but also the commitments of any blog or site linked to fiskarettes, and make sure to use only sites whose content and rules of use you agree with.
The company Fiskars declines any liability regarding any link to an external site and referring to the Fiskarettes blog. The Fiskarettes blog cannot be associated with another site and its contents unless specifically authorized by the Fiskars company.

If Fiskars learns from a third party that his/her data has been registered by a User, than Fiskars will delete the data of rthe third party in order to protect his/her rights.
Any breach of these conditions by a Member, including the required criteria for acceptable articles and comments, may lead the publication manager to unsubscribe/unregister the Member, without prejudice of any damage, if appropriate.
